Chiromo hospital wants posh Lavington restaurant's licence revoked

Chiromo Hospital group issue complaint against Numero 5 and Kettle House Bar & Grill

Chiromo Hospital Group has written to the Nairobi City County Alcoholic Drinks Control and Licensing Board complaining against the popular Numero 5 Bar & Restaurant and Kettle House Bar & Grill.

According to official documents seen by Mpasho.co.ke, the Hospital group is issuing a complaint against the two establishments which are situated along Muthangari road over noise pollution.

Through their lawyers Mboya Wangong'u & Waiyaki, the group wrote, "Our Client operates a hospital along Muthangari Road, Lavington, within the same locality as Numero 5 Bar & Restaurant and Kettle House Bar & Grill hereinafter referred to as the ("Clubs").

We are instructed that in the last 2 - 3 years, your office has issued licenses for the operation of the said clubs. We write to express our Client's concerns over the operation of the said clubs in the area and the resultant noise polluton and other violation of the law."

They complained that the noise emanating from the two establishments is quite significant terming it as a great inconvenience and nuisance to area residents, the hospital and its patients.

Their prayer is that they be accorded a quiet, peaceful and serene environment which are key factors in the recovery of their patients, which is contrary to what they've been getting despite numerous complaints.

"We are instructed that despite there being clearly prescribed noise levels, these clubs have failed to adhere to the same. Our Client has incessantly complained to the management of these clubs but they have failed to control the noise emissions emanating from their establishments.

Their failure to take remedial steps, is an infringement on our client's constitutional rights as well as those of the residents of the area who are entitled to a tranquil environment devoid of any disturbance," the letter reads.

As a way to mitigate the noise and the headache caused by the establishments, Chiromo Hospital Group called on the alcohol board to;

a) revoke their licenses;

b) cause the abatement of the excessive noise emanating from the clubs and ensure compliance by the clubs with the prescribed noise levels set in law and;

c) to review the licenses issued to the clubs in the area to ensure compliance with the law.
