No one ever envisions living their life in prison.
But like they say life has no manual and sometimes circumstances lead us to do things that might lead us to jail.
Below are simple reasons you did not know might land you in jail.
These actions might be intentional or not.
1. Abusive texts
Some people have perfected the art of being abusive at every little provocation.
Women are the worst culprits. Most will pick up their phones and abuse the other women they suspect their men are going with.
On different occasions, we have seen these texts or calls land people in court. Before you dial that send button, be very careful.
2. Stalking
We know that not everyone takes it lightly when they get dumped. The need to stalk your ex might be alluring but keep in mind it might land you in trouble.
The law defines stalking as pursuing or accosting a person. It is considered harassment and as such falls under domestic violence.
3. Trespassing
Trespassing can be in different forms.
It can be going to someone's workstation, their house, or other areas they might be without their permission.
It becomes a crime when the person is a threat to the subject.
According to the Kenyan law any person who without reasonable excuse enters, is or remains upon, or erects any structure on, or cultivates or tills, or grazes stock or permits stock to be on, private land without the consent of the occupier thereof shall be guilty of an offense.
4. Sharing intimate videos and photos
President Kenyatta assented to The Computer Misuse and Cybercrime Act 2018.
The Act under section 37 which creates the offense provides that;
A person who transfers publishes, or disseminates, including making a digital depiction available for distribution or downloading through a telecommunications network or through any other means of transferring data to a computer, the intimate or obscene image of another person commits an offense and is liable, on conviction to a fine not exceeding two hundred thousand shillings or imprisonment for a term not exceeding two years or both.
The offense applies both online and offline and to images that are shared electronically or in a more traditional way so including the uploading of images on the internet, sharing by text and e-mail, or showing someone a physical or electronic image.
It criminalizes the sharing of private, sexual photographs or films, where what is shown would not usually be seen in public.
Sexual material not only covers images that show the genitals but also anything that a reasonable person would consider to be sexual, so this could be a picture of someone who is engaged in sexual behavior or posing in a sexually provocative way
5. Refusing to pay a bill
We have in the past seen Kenyan socialites and normal mwananchi being arrested for failing to pay hotel bills.
Months ago Mishi Dora spent days in prison after she allegedly failed to pay cash 150,000 which she used on drinks.
Pendo had in the past been alleged to have been arrested after her then mzungu boyfriend left her with a huge hospital bill.
