Ni Kubaya! Court Rules That Senate Has Powers To Summon Governors

A three bench led by Justice Isaac Lenaola, Mumbi Ngugi and George Odunga have ruled that the senate has a constitutional mandate to play an oversight role for the accountability and management of county funds.

The Judges said because governors are the county bosses they have no right to defy summons by senators and insisted that if they feel that they should not be asked to account they are in order to have in their company the county executive officers in charge like the county accounting officers to respond to certain questions.

The judges, however, ruled that senators are not to direct Treasury on which counties to release funds and those which to deny funds.

They ruled that senators represent the general public who have a right to know how county funds are utilized. The Council of Governors had moved to court questioning jurisdiction of Senate to summon them.
