Director of Public Prosecution Noordin Haji now says that he will appeal the decision by a magistrate to acquit former Nairobi governor Mike Sonko in a Sh20 million graft case.

Haji on Wednesday said the magistrate was involved in the pretrial engagement where he approved the charge sheet, which he has now ruled as defective.

He insisted that the court acquitted Sonko on the basis that the charge sheet was defective, and not on merits and substance of the case.

"We have solid evidence on who received that money and how. We will appeal the ruling immediately," he said.

The DPP said called a total of 19 witnesses and produced 113 documentary exhibits in support of its case and closed its case on 27th July 2022.

Sonko was acquitted in a Sh20 million graft case by anti-corruption magistrate Douglas Ogoti.

He had been charged with conspiracy to commit an offence of corruption namely embezzlement of public funds amounting to Sh24 million from the county government of Nairobi.

Sonko was also facing up to more than 30 charges of money laundering, receiving bribes and conflict of interest.

Sonko was first arraigned in December 2019.

Haji accused Sonko and his associates of the misappropriation of Sh357 million from City Hall.

The arraignment was followed by a weekend in jail after a dramatic arrest in Voi.
