Man charged for failing to return Sh29k sent wrongly

A man who allegedly failed to return Sh21, 900 which was wrongly sent to him via M-Pesa has been charged in court.

Caston Majanja was charged before Makadara senior principal Agnes Mwangi but denied the charges and was released on Sh25,000 cash bail with the surety of the same amount.

He was charged with intentionally withholding payment delivered erroneously contrary to section 35 of the computer misuse and cybercrime Act of 2018, the court heard.

The charge sheet read in court shows that James Deng committed the offence on March 25, 2023, at Sports View estate within Kasarani, Nairobi county.

The accused person was also charged with the second count of obtaining money by false pretenses contrary to section 313 of the penal code.

The accused person had allegedly posed as a caretaker when he obtained the said amount from the complainant—a student at a college in Nairobi’s CBD.

The case will be mentioned on April 18, 2023, and the hearing starts on September 6, 2023.
