Prosecution intend to charge Chris Obure with failing to secure his weapon

Two suspects linked to the murder of car dealer Kelvin Omwenga at Galana suites apartment in Kilimani will take murder plea today after psychiatric tests showed they are fit to stand trial.

This was after the suspects- Chris Philip Okeyo Obure and Robert Bodo Ouko- were Friday taken for tests at the Mathari Mental Hospital where officials gave them a clean bill of health.

A court had Friday directed the prosecution to make sure the suspects are taken for mental assessment before Monday and be held at their respective police cells awaiting plea taking.

Police said they had evidence linking the two to the murder. The prosecution said they intend to further charge Obure with another charge of failing to secure his weapon.

Prosecutor Allan Mogere told the court that preliminary investigations showed that Omwenga, 28, was shot in his bedroom with a firearm belonging to Obure.

The shooting incident happened on August 21 in the bedroom of Omwenga at Galana Suites along Galana Road, Nairobi. Ouko told police he shot Omwenga accidentally as they were exchanging the pistol.

Ballistic results from the Directorate of Criminal Investigations (DCI) show that the ceska pistol registered to Obure was used in the scene of crime, with fingerprints positively traced to Ouko.

An autopsy carried out by the chief government pathologist Johansen Oduor showed that the bullet that killed the Nairobi businessman hit him from a close range, tearing through his heart and left lung and was shot from an elevate angle.
