A junior official at Kenya Rural Roads Authority (KeRRA) who amassed Sh21 million in 4 months will on November 9 know whether the court will set aside orders that froze his accounts.
Daniel Wambua has claimed that the monies were meant for his dowry ceremony having received it from well-wishers.
The anti-graft agency however said his explanation is an afterthought.
Through Lawyer Danstan Omari, Wambua told Justice Nixon Sifuna that he had a dowry payment account domiciled at Equity Bank.
It was opened on March 14 and credited with Sh21 million within four months.
That account was among the three accounts frozen by the court.
He explained how a Whatsapp group had been formed with at least 957 people with the sole purpose of contributing to the dowry ceremony.
The Whatsapp group was dubbed the "Daniel Wambua dowry payment account".
Omari said there were more than 20 administrators and 950 people contributed. Seven contributed over Sh 200,000.
He also provided the court with manual notebooks for those who contributed physically.
Omari disputed claims by the EACC that his client earned a salary of Sh55,000 per month stating the correct figure to be Sh170,000.
The dowry payment was to be on August 5 with a budget of Sh20 million. They however managed to raise Sh21 million.
In a brief rejoinder, the Ethics and Anti-Corruption Commission (EACC) urged the court not to vacate the preservation orders.
"This is an accountant at Kerra. He earns a monthly net pay of sh 55,000. That amount is less than Sh800,000 in a year but in a span of 3 months, he deposited Sh1.7 million, said the EACC.
The commission told the court that the huge cash deposits by Wambua were suspicious.
It said since he has not satisfied the court that the monies were not acquired as a result of corrupt conduct, then the orders freezing his accounts should not be set aside.
"Explanations by Wambua do not hold any water. He claims he obtained the monies through farming but no evidence to support the same," said the commission.
The court heard that the pictures of maize and land adduced by Wambua as proof do not translate to the sh 21 million frozen in his three bank accounts.
Eacc said his dowry already took place on August 4 and that the explanation of him needing the money for the ceremony cannot be true.
"The accounts were frozen on August 10. Wambua had an opportunity to withdraw the money and pay dowry but he didn't because the sh 21 million was never meant for dowry," said the commission.
The agency said vacating the orders preserving Wambua's account will render other proceedings which they intend to initiate against him an exercise in futility.
