Eldoret woman causes drama in court over 50/50 verdict

A woman caused drama by heavily protesting in an Eldoret court about a 50/50 child upkeep judgment. The Friday incident was captured by Nation Media in a video inside the courtroom where audiences silently looked on as the woman shouted at the court clerks.

"Nimeamua nimeshindwa case. What will the child eat? How will this child have a meal," she asked the attendees in the courtroom

"This child will live with the mother! Me, me..niende kazi nikuje na watoto wawili.  I feed them, then I have to pay school fees...*inaudible*..that school even that child hasn't started school yet.  Which school fees? Of which school fees yenyewe that child hasn't started school," she cries out to the courtroom.

She appeared frustrated and wanted answers on how she would come up with her share of the child's upkeep costs.

According to changes made in the law in 2022, child upkeep costs were split 50/50 with both parents contributing to the child's well-being.

It is no longer that the man shoulders sole financial responsibility for a child unless he volunteers and does so.

The woman continued to rant to the court, "Nyinyi ni nini kweli? What is this? I have refused that judgment, let him go take custody if he wants, he can take the children, mimi sitaki tena, I don't want. If it is that school fees ata achukuwe watoto then I will pay that school fees," she announced to the curious onlookers.

She added, "Then he can take the children and do all those things that the courts say the woman should take care of. Si we are 50/50? I live with the children, already I have already contributed my 50 percent.  There are five things: food, rent,  clothing, and medication," the angry woman shouted.

The woman argued that the court had overburdened her with those five items including school fees and living with the children. "How am I going to do this? How?  The children are not school-going age, school fees gani? They say the children's court is in favour of children," she said that her child is nine months old.

A voice of someone interrupted her urging her to take the judgment and read it then she could make another application if she was not happy with it.  The woman protested alleging the process would still be flawed.

"No way that is not judgment, in fact, I have never read such even on the internet, ata wapi even on TV when I watch, I have never seen such a judgment."

The angry woman then walked out and made phone calls for the children to be dropped off at the father's so he could bear full responsibility.
