Court gives date for hearing of Dj Brownskin's 'suicide case'

The DJ is out on a bond of Sh200,000 or a cash bail of Sh100,000.

A Nairobi court has scheduled a hearing on August 12 in a case where DJ Brownskin, also known as Michael Macharia Njiiri, is accused of helping his wife commit suicide last year.

Following his appearance in court for his pretrial, Milimani Chief Magistrate Lukas Onyina set the date for the hearing.

The DJ has refuted allegations that he helped his wife Sharon Njeri Mwangi commit suicide on July 29, 2022.

He faced a second count of failing to use all reasonable force to prevent his wife from committing suicide although he had knowledge that she was planning to commit suicide.

He is also accused of deleting evidence of suicide from his phone on June 1, 2023, knowing that the material will be needed in legal procedures.

When DJ Brownskin sought to summon DCIO Kasarani to court for contempt earlier, magistrate Onyina denied his request.

The DJ had asked that DCIO Kasarani Jimmy Kimaru, who had been brought before a Makadara court last week for violating court orders, be ordered to appear in court through his attorney Duncan Okatch.

The Makadara Law Courts, which have equal jurisdiction, issued the court orders allegedly disobeyed, the court ruled, therefore it cannot establish any offense of contempt.

The magistrate mentioned that Njiiri had been charged with helping suicide and had appeared in his court to enter a plea.

Following the plea, his attorney requested that this court call DCIO Kasarani for disobeying court orders.

He claimed that the defense attorney for the accused had claimed that his client had been forced to confess to the crime in order to be granted release.

The prosecution attorney informed the court that because the defense's concerns stem from a case that is currently pending in the Makadara Law Courts, only Makadara has the authority to answer the application.

"I do agree with the prosecution that indeed the file before this court does not have any contempt. I, therefore, direct the defense counsel to move Makadara Law Courts with the application to summon the DCIO if it deems fit," ruled the Court. 

The DJ is free on a Sh200,000 bond or a Sh100,000 cash bail.

Milimani Chief Magistrate Lukas Onyina said he had taken into account the pre-bail report, which was in his favor, before releasing him on bail on Monday.

"I have considered the report before me which favours the accused as he is not a flight risk if released. I grant him a bond of Sh200,000 or a cash bail of Sh100,000", the magistrate ruled.

The case will be heard on August 12.
