"When I met Owino, he had no gun at the Club and I never saw a firearm that shot me.
I was having conversations and the next thing I was in a vehicle going to the hospital. I did not see where the bullet came from," Orinda testified.
Miguna insisted that Evolve who was allegedly shot by MP Babu Owino should have been under the protection of the Office of the Director of Public Prosecutions.
He added that the court should not rely on DJ Evolve's testimony but on ballistic forensic experts in the case.
"This isn’t a case that requires DJ Evolve to testify. Babu would be convicted even if DJ Evolve was dead or incapable of speaking or comprehending what was going on. But Kenya’s legal system is broken and rife with ineptness and corruption. DJ Evolve should have been under protection by the ODPP_KE.
"There should have been a strict restraining order preventing Babu Owino from communicating with DJ Evolve - directly or independently - in order to preserve the integrity of the system, evidence, and witnesses," Miguna said.
