A 37-year-old preacher who had appealed his life imprisonment sentence for defiling a 10-year-old girl has been sentenced to 10 years on an alternative count.
He was also accused of showing a pornographic video to the girl.
Francis Wanyonyi was said to have defiled the girl between May 1 and 30, 2016, at a maize farm in Trans Nzoia county.
Alternatively, he was accused of committing an indecent act with the child by paying her Sh5, whenever he defiled her. He denied the charges and the matter went to a full hearing.
Wanyonyi was found guilty and jailed for life, but he appealed at the High Court in Kitale. Some of his grounds of the appeal included claims the complainant’s aunt was his employee and failure to consider contradicting evidence.

During the hearing, the complainant’s aunt told the court that at one time, she found Wanyonyi and the girl watching a video on his phone.
She said Wanyonyi was leaning on the complainant as they watched the video. The girl followed him shortly after and came back two hours later, claiming she had gone to the toilet.
The girl later said she had gone to the maize field to have sex with the appellant, who was a teacher and a pastor.
She confessed they had been having sex for some time in exchange of between Sh5 and Sh10.
In cross-examination, she denied having been told by her aunt and her grandmother what to tell the court.
