Joho's Relief As His Degree is Upholded And Termed Genuine

MOMBASA Governor Ali Joho's undergraduate business degree is legal, the High Court in Uganda ruled yesterday.

The court dismissed the decision of the National Council of Higher Education of Uganda not to recognise the certificate. The council on April 30 declared the Kampala University certificate was suspect.

Justice Stephen Musota in Kampala delivered the judgement and criticised the National Council of Higher Education for giving in to external pressures in arriving at its decision.

The judge held that the National Council of Higher Education had no jurisdiction to recall or not recognise individual degrees awarded by any University in Uganda.

The judge said the power to do so is vested in a University Senate under the provisions of the Universities and other Tertiary Institutions Act, 2001.

Joho's lawyer Dennis Mosota said the judgement has far reaching effects. Musota took issue with the manner in which the National Council of Higher Education conducted the proceedings.

He condemned public officials "sitting behind their desks and trampling" on the guaranteed rights of private citizens without giving them a right to be heard.

In April at a special meeting the National Council of Higher Education passed a resolution saying: "There was no clear evidence that academic due process was followed from admission to graduation regarding a Bachelor of Business Administration Decree (Human Resource Management Option) awarded to Mr Hassan Ali Joho by Kampala University. And therefore, the Council resolved that it did not recognise the Bachelor of Business Administration degree awarded to Mr Hassan Joho by Kampala University on February 28, 2013."
