Your honour, Yes, I destroyed my cheating wife's property! Man freed despite pleading guilty

A man has been set free by a Kapenguria court despite pleading guilty to a charge of maliciously damaging the property of his wife whom he caught red-handed with a man on their matrimonial bed.

The court was told that Joseph Rionosia on June 28 at Ptokou Village in Pokot Central sub County willfully and unlawfully destroyed assorted household items worth Sh60, 000 belonging to his wife, Josephine Moroto.

Resident Magistrate Godfrey Okwengu was told Rionosia walked into his house and found a man in his bedroom with his wife but the man slipped from his grip and fled before he could identify him.

Infuriated, the man turned his anger on his wife who was trembling in bed and ordered her out of the house while showing her the direction of the door with the panga that he was holding.

It was after his wife left that he turned to the property which he chopped indiscriminately. His wife then went to court accusing her husband of damaging her things and wanted compensation.

The accused pleaded guilty to both charges saying he was carried away by his emotions but reminded the court that despite his fit of anger, he did not harm anyone with the panga that he had in his hand. He promised the court he would never let himself get carried away by emotions again.

In his ruling, Resident Magistrate Okwengu noted that the accused had done less harm especially in control of his emotions against physically hurting someone. The accused was discharged under section 35(1) of the Penal Code.
