Maseno businessman charged with defiling daughter

His request to be released on bond was rejected by the prosecution team.

A prominent businessman in Maseno was on Thursday charged with defilement.

The suspect identified as Hassan Wandera Osinya appeared before Maseno Senior principal magistrate Christopher Yalwala.

He was accused of allegedly defiling his class eight daughter aged 14 on various dates in December 2020, and in June this year.

The suspect who was not represented by a lawyer pleaded not guilty. His request to be released on bond was rejected by the prosecution side.

The investigations officer police constable Evelyn Momanyi said the suspect was a flight risk and should not be given bail.

According to the officer, the accused's rural home is in the border town of Busia and he is likely to disappear to neighbouring Uganda.

"He also has the financial muscle and is likely to interfere with the matter if released on bond," she told the court.  

The prosecution appealed to the magistrate to consider hearing the matter urgently because the victim is a KCPE candidate.

She is at the child protection unit at Maseno police station. 

The court heard that the accused had allegedly been having sex with his daughter who is living with her stepmother.

The victim's mother divorced the suspect.

The magistrate directed that the suspect be remanded at Kisumu GK prison to await the report of the probation officer on whether he can be granted bond.

"I have considered the application by the prosecution and the accused and direct he be remanded as the probation officer prepare a report which will be considered alongside that of the prosecution side," he said.

He fixed the hearing of the case for June 30 and mentioned will be mentioned on June 16.
