“The complainant in this case was in Parklands at the Deep Sea when he was approached by the accused and uttered the abusive words to him three times,” Kerubo told court.
The court heard that Dida had used the words severally and the same had been reported to the Borana elders within the area who intervened and reconciled the two, but the accused repeated the insult forcing the matter to be reported to the police.
In his mitigation Dida urged the magistrate to forgive him and promised never to repeat the offence.
Boke ordered him to pay a Sh5,000 fine or spent five months in jail.
She gave him 14 days to appeal if he so wished.
