'She is cohabiting with my husband and has a posh life,' wife tells court

A woman accused of assaulting her immediate neighbour narrated to a Kabarnet court how she was suffering with her children while the complainant was cohabiting with her husband.

Ann Ledekur while testifying told the court ,

“Your honour, I am suffering with my children yet the complainant who is cohabiting with the father of my children is living a posh life.”

The complainant, Caroline Mwangi Wamboi, on her defence before Senior Principal Magistrate (SPM) Paul Biwot vehemently denied all the allegations labelled against her by Ms Ledekur stating that she has never seen and doesn't know the husband of the accused.

Ms. Ledekur was charged that on August 26, 2019 at around 10:00am at the sprawling Kampi Turkana village in Yatoi sub location of Marigat Sub County, she unlawfully and intentionally assaulted Caroline Mwangi Wamboi thereby occasioning her actual bodily harm.

The complainant narrated to the court how the accused while she was returning to the house from fetching water in a nearby stream, pounced and pushed her hard sending her sprawling on the ground with a 20 litre jerican.

Upon falling down, she added, the accused continued beating her until neighbours came to her rescue and after being separated, the accused threw stones at her as she sought refuge in her house hitting on the right leg and forehead inflicting serious injuries.

A witness, Alphonce Longor Epur, who testified said that he was in his house when he heard a woman screaming and when he went outside, he saw the accused attacking the complainant at around 10:00 am on a fateful day.

“I saw Caroline returning home after fetching water in a nearby stream and she was laying down with the water container beside her while the accused, Ann Ledekur was on top of her raining blows,” said Epur.

Epur informed the court that he called for help from other neighbours who assisted him to rescue Wamboi from getting more harm by the accused who had overpowered her.

"Immediately, we successfully managed to separate the fighting women, the accused threw stones that led to Wamboi getting hurt at the right ankle and forehead,” he said.

Epur further informed the magistrate that police who had been alerted by the complainant arrived at the scene, took the accused, the complainant and her Grade 3 boy to record statements after which the accused was remanded at Marigat police station.

The Grade 3 pupil who testified narrated to the court how her mother was attacked by the accused who punched, insulted and threw stones at her through the door of their house which was open.

The assault is alleged to have been caused by a love text message seen by the accused in her husband mobile phone making her turn wild and sought for the complainant who she has been suspecting to have an illicit affair with her husband.

The magistrate noted that the accused assaulted the complainant causing actual bodily harm contrary to Section 251 of the Penal Code.

The magistrate adjourned the case until September 25 when the hearing will resume.
