The men arrested for undressing women likely to walk scot free

Police are at a loss over what charges to prefer against the more than 90 men arrested in a swoop following increased cases of women being stripped naked in Nairobi.

The assailants claimed that the women whom they forcibly undressed in public were indecent in their dressing.

With the incidences averaging one per day over the last one week, police were obviously under pressure to be seen to act. And they did. More than 90 men found idling at various bust termini were arrested this week; but then what?

With no particular law relating to such an offence, police are not sure what to do with the suspects.

Sources within the force say the suspects will most likely be charged with the lesser offence of touting, simply because it is difficult to sustain any sexual offence charges against them.

The Revised Traffic ACT of 2013 prescribes a maximum fine of thirty thousand shillings for the offence of touting for first time offenders and up to fifty thousand for repeat lawbreakers.

Those arrested were to be arraigned at the Makadara and Milimani courts on Wednesday morning.
